Terms of Service

These Terms of Service (“Terms”) govern your use of the ProFixNow website at profixnow.com (the “Site”) and any related services provided by ProFixNow (“ProFixNow,” “we,” “our,” or “us”). By accessing or using the Site you agree to these Terms. If you do not agree, do not use the Site.

1. What ProFixNow Is

ProFixNow is a lead generation marketplace that connects homeowners who need home services with independent, local service professionals (“Contractors”). ProFixNow is not a contractor, does not perform services, and is not a party to any agreement between a homeowner and a Contractor.

We operate a network of city-specific landing pages. When a homeowner submits a service request, we route that lead to one Contractor in our network who covers that trade and city. Any resulting work, pricing, scheduling, or dispute is solely between the homeowner and the Contractor.

2. Homeowner Terms

2.1 Accuracy of Information

By submitting a service request, you represent that all information you provide is accurate, current, and complete. Submitting false or misleading information is prohibited and may result in removal from the platform.

2.2 Consent to Be Contacted (TCPA)

By submitting a service request, you expressly consent — on behalf of yourself — to receive calls, text messages (including via automated telephone dialing systems or pre-recorded messages), and emails from ProFixNow and from Contractors in our network at the phone number and email address you provide. This consent applies even if your number is on a national or state Do-Not-Call registry.

You may revoke this consent at any time by replying STOP to any text message or emailing privacy@profixnow.com. Revoking consent will not affect processing of any prior service request.

2.3 No Guarantee of Contractor Availability

We do not guarantee that a Contractor will be available in your area, will contact you within any particular timeframe, or will agree to perform the requested work. Contractor availability, pricing, licensing, and insurance are the sole responsibility of the Contractor and should be independently verified before you authorize any work.

2.4 Verify Before You Hire

We recommend verifying any Contractor's state license, liability insurance, and references before authorizing work. ProFixNow does not vet, endorse, or guarantee the credentials, quality, or conduct of any Contractor.

3. Contractor Terms

3.1 Eligibility

By applying to our network, you represent that you are a legitimate business or sole proprietor operating lawfully in your state, that you hold all required licenses and insurance for your trade, and that you have the authority to enter into these Terms.

3.2 Free Trial Leads

New Contractors receive up to 10 free leads. Free leads are sent after email verification is complete. We reserve the right to adjust the number of free leads at any time for new sign-ups.

3.3 Billing

After your free trial is complete, leads are billed on a per-lead basis at the rate shown in your contractor portal. Charges are applied at the time of lead delivery using the payment method on file. All charges are in U.S. dollars.

Payment is processed securely by Stripe. By providing a payment method, you authorize ProFixNow to charge that method for each lead delivered after your free trial ends.

3.4 Territory Exclusivity

Each trade/city combination is limited to one active Contractor. As long as your account is active and verified, you are the exclusive recipient of all leads for your trade in your city.

Important: If your account is paused for more than 7 consecutive days, your territory may be released and made available to another Contractor. You will receive email notice before your territory is reassigned. To retain your territory during extended gaps, contact us at leads@profixnow.com.

3.5 Lead Quality and Credits

A “lead” is a homeowner request that includes a valid name and phone number. If a lead contains incorrect contact information or is clearly fraudulent, email leads@profixnow.com within 72 hours of receipt with the lead ID and the reason for the dispute. We will review the request and, at our sole discretion, issue a credit toward a future lead. Credits are non-refundable and non-transferable.

We do not issue credits for leads where the homeowner was simply unresponsive, chose a different contractor, or you were unable to win the job.

3.6 Pausing and Cancellation

You may pause or cancel lead delivery at any time from your contractor dashboard. Pausing stops future leads from being routed to you. No charges are incurred during a pause. To permanently close your account, email leads@profixnow.com.

3.7 No Guaranteed Lead Volume

Lead volume varies by city, trade, and season. ProFixNow does not guarantee a minimum number of leads per day, week, or month. You are only charged for leads actually delivered.

3.8 Contractor Communications Consent

By submitting a contractor application, you expressly consent to receive lead notifications, billing communications, and service-related messages from ProFixNow at the phone number and email address you provide, including via SMS (text message) and automated calling systems. Message and data rates may apply. You may opt out of SMS at any time by replying STOP, or by updating your preferences in your contractor dashboard.

3.9 Termination by ProFixNow

We reserve the right to suspend or terminate a Contractor's account for any of the following: unpaid charges, misrepresentation of credentials, verified homeowner complaints about fraudulent or dangerous conduct, or any violation of these Terms. We will generally provide notice before termination except in cases of serious misconduct.

3.10 Refund Policy

All lead charges are final and non-refundable except as provided in Section 3.5 (Lead Quality and Credits). ProFixNow does not issue cash refunds. Credits issued under Section 3.5 are applied to future leads and have no cash value.

4. Prohibited Conduct

You agree not to:

  • Submit false or misleading service requests or applications
  • Use the Site to harvest contact information for purposes other than genuine service requests
  • Attempt to reverse-engineer, scrape, or circumvent any part of our systems
  • Resell, transfer, or share lead information with third parties
  • Harass, threaten, or engage in abusive conduct toward homeowners or ProFixNow staff
  • Violate any applicable federal, state, or local law in connection with use of this Site

5. Disclaimer of Warranties

THE SITE AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PROFIXNOW AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY SERVICES PROVIDED BY CONTRACTORS REFERRED THROUGH THE SITE.

PROFIXNOW'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO PROFIXNOW IN THE 3 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

7. Indemnification

You agree to indemnify and hold harmless ProFixNow and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Site; (b) any service performed or not performed by a Contractor; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of a third party.

8. Intellectual Property

All content on this Site — including text, graphics, logos, page design, and software — is owned by or licensed to ProFixNow and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

9. Third-Party Links

The Site may contain links to third-party websites. These links are provided for convenience only. We do not endorse and are not responsible for the content, privacy practices, or accuracy of any third-party website.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall first be submitted to informal negotiation by emailing legal@profixnow.com. If not resolved within 30 days, the dispute shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with the arbitration conducted in Denver, Colorado.

Class Action Waiver: You agree that any arbitration or legal proceeding will be conducted on an individual basis and not as a class, collective, or representative action.

Arbitration Opt-Out: You may opt out of the arbitration requirement by sending written notice to legal@profixnow.com with “Arbitration Opt-Out” in the subject line within 30 days of first accepting these Terms. Opting out does not affect any other provision of these Terms.

11. Severability

If any provision of these Terms is found to be unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by updating the effective date above. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
